A draft of the “Representative Joe Barton’s Bill in the House (Gambling Prohibition, Poker Consumer Protection and Strengthening UIGEA Act of 2012),” a bill supporting online gambling legalization including Internet pokier, is now in circulation. Originally proposed by Harry Reid (Nevada) and Jon Kyl (Arizona), the bill suggests the regulation of the online poker industry and the legalization of the online poker, and proposes to toughen up some existing poker legislature.

First of all, this bill will revoke the DoJ’s recent announcement that the Wire Act of 1961 doesn’t apply to online casino and online poker betting. In addition, it recommends amendments to the 2006 UIGEA, the Wire Act of 1961, and the IGBA (Illegal Gambling Business Act) of 1970.

If passed, the bill will require a new government agency of the department of commerce to be called the Office of Online poker Oversight (OOPO) that will oversee all intrastate gambling as well as Indian gambling. This agency will also receive applications for licensure and then grant gambling licenses with the stipulation that any online gambling company that continued to operate within the US post-UIGEA will be denied a license. Fortunately for PokerStars, part of their recent Full Tilt Poker deal with the DoJ forgives them of any post-UIGEA US activity, so that they will be able to apply.

The bill furthermore proposes to prohibit all state-level gambling except online poker and horse racing betting and then suggests up to 10 years in prison plus fines if any other forms of bets are taken.

Malta and Denmark licensed operator iGame Malta Ltd one of the largest skins on the IGT Poker network, is set to move its poker offering to the Microgaming Network towards the end of this year, bringing with it a player base of over a million members with skins like 24hPoker.com, Pokerihuone.com, Casinohuone.com, NoiQ.com iGame.com.

Microgaming head of network games Lydia Melton (pictured) said the software provider is in “Advanced discussions with a number of other major operators looking to join the Microgaming Poker Network,” adding that “We look forward to announcing more operators joining the network in the near future.”

Betfair has struck a deal with Playtech which will allow it to offer online poker in regulated markets which it does not currently have access to.

The company currently hosts all its poker on the Ongame network which is for sale.

It will offer poker via Playtech in the Spanish market, which was regulated earlier this year, by the end of October. It is also looking at entering the Italian online poker market.

Group operations director at Betfair, Ian Chuter, said, “Betfair has built a strong relationship with Playtech over a number of years and after a full evaluation of the available options, they were the logical choice for providing us with what we now need.

“This deal allows us to offer a compliant Poker solution in markets where historically we have not been able to and the wider agreement is further evidence of how serious we are in providing our customers with a high quality one-stop shop for all their betting needs.”

Earlier this month Playtech announced it had signed a deal with BetClic Everest Group to host the formerly independent Everest Poker on its poker network.

On Thursday, Nevada’s five-member Gaming Commission granted licenses to WMS Gaming Inc. and American Casino & Entertainment Properties to be involved with the state’s upcoming intrastate online poker industry. WMS is a technology firm, while ACEP owns a number of Nevada casinos.

Their coupling on Thursday doesn’t mean that they will necessarily do business together.

Commission Chairman Peter Bernhard asked WMS about its online operations in Europe, inquiring specifically about whether it opened up to a country where the activity was deemed to be legal, rather than offering games everywhere and then later “blocking” access to countries with legal grey areas.

In Nevada, regulators have hammered home their desire to know that online poker licensees did their “due diligence” to prevent accepting online wagers from individuals in jurisdictions where the activity isn’t explicitly OK. This standard applies to their subsidiaries and partners.

ACEP Interactive received a license to exist as an “operator” of online poker, which is a distinction given only to brick-and-mortars. The company owns several Nevada properties, including the Stratosphere Hotel Casino and Tower.

Online poker provider, BetVictor, has announced that they have chosen Microgaming to be their exclusive poker provider. Microgaming Systems is the largest provider of online gaming software in the industry and by the end of September, the full migration of BetVictor Poker to the Microgaming Poker Netwrok will be complete.

Head of Poker at BetVictor, Andy Horne, commented on the change by stating: “We’re looking forward to consolidating our online poker business on the Microgaming Poker Network, where we’ve been serving customers in a variety of international markets since late last year. Providing the best poker experience possible is our top priority, and we’re sure that the MPN will continue to deliver in this respect.”

Head of Network Games at Microgaming, Lydia Melton, commented on the partnership as well by stating: “We’re delighted that BetVictor has chosen to make the Microgaming Poker Network its exclusive poker provider. The MPN has seen significant advances over the past year, with developments by the Network Management Board and the launch of our True Value rake allocation method making it the natural choice for leading operators. we’re confident that BetVictor players will feel very at home on the Microgaming Poker Network.”

Along with this announcement, it was also reported that the Microgaming Poker Network has been in advanced discussions with several major operators in the online poker industry. The MPN is apparently looking to add even more poker rooms to their poker network. iGame Malta Ltd is one other group that has decided to join the Microgaming Poker Network and many more may soon follow.

It will be interesting to see which other groups decide to join the Microgaming Poker Network. Hopefully, in the coming weeks more information will be released as to whom the MPN has actually been discussing moves with.

Phil Galfond is a top poker pro who has been able to earn millions in profits by playing cash games at top online poker sites such as Full Tilt Poker and PokerStars. The pro is only 27 years old but his poker advice has been sought after for many years. The pro previously worked for Bluefire Poker, as a lead instructor, offering the best in poker advice. The pro left the company in 2011 and is now suing Bluefire Poker for his share of profits.

Galfond’s videos at Bluefire Poker were the highest rated videos on the information site and it was very surprising when the pro decided to leave in 2011. Galfond reported that he parted ways with the training site but did not give a real reason why. At the time, Galfond stated that it was a very difficult decision to leave the site that he helped build from the ground up.

Now it seems that the two parted ways in a negative fashion. Galfond is now suing his business partner William F. Murphy for past due profits. Galfond claims that Murphy failed to pay him his part of the profits from the Bluefire Poker website.

According to a recent agreement signed between Playtech and Betfair, the latter will be enabled to operate real money online poker services in regulated markets, which it cannot access at present. Betfair is one of the skins on the Ongame Poker Network, which is now put up for sale. The Las Vegas based Shuffle Master decided at the last minute not to acquire Ongame Network from Bwin.party Digital Entertainment Plc, the world’s largest online gambling company. Gavin Issacs, CEO of Shuffle Master, said, “It has become evident to us that Ongame’s operations post-acquisition will not achieve the near-term results we initially expected and will require a larger ongoing investment than anticipated.”

Bwin.party is now trying to sell the network to other interested parties such as Bet24 and Gala Coral. The company stated, “The sale of surplus assets, including Ongame, remains a core part of bwin.party’s strategy. Bwin.party is re-engaging with other third parties that have expressed an interest in acquiring Ongame. bwin.party will make a further announcement as and when appropriate.”

Betfair will now offer online poker through Playtech in Spain, which regulated its online poker gaming industry early this year, toward the close of October. Betfair is also mulling over gaining entry into Italy.

Nevada gambling regulators have approved licenses for three companies to run Internet poker sites in the state.

The Nevada Gaming Commission on Thursday approved American Casino & Entertainment Properties LLC for an interactive gambling operator's license.

The company owns the Stratosphere hotel-casino and tower on the Las Vegas Strip.

The Las Vegas Review-Journal reports gambling officials were told ACEP plans to launch a free-play poker website that doesn't handle real money by the end of 2012, and a poker site accepting real-money bets in 2013.

The Las Vegas Sun reports slot machine maker WMS Industries Inc. of Waukegan, Ill., was also approved for a license as a service provider and interactive gaming system manufacturer.

Las Vegas-based PokerTrip Enterprises Inc. was approved for a license as an online poker marketer.

Online poker is considered the biggest internet gambling activity. Companies involved in offering online poker have been under attack in the US jurisdiction and it has been given a rough road to follow leaving the player a little confused and wondering whether it’s safe to open an account to play. When looking at the worldwide market for internet poker there are some firms that have dominated and others that are busy trying to capture market share.

Betfair the West London based firm went offshore in 2011 and is now registered and licensed in Gibraltar. Since Betfair was launched in June 2000 it has become the largest online betting company in the UK and the largest betting exchange in the world.

Senate Majority Leader Harry Reid was trying to brand fellow Nevada Sen. Dean Heller a failure earlier this month when he wrote that passing an online poker bill was “the most important issue facing Nevada since Yucca Mountain.”

Yet in doing so, Reid also elevated a controversial piece of legislation that is iffy at best to a defining element of his own legacy — as significant as ridding the state of a nuclear waste repository.

The effort to legalize Web poker and ban all other forms of Internet gambling by year’s end is about to test Reid’s much-touted ability to deliver for his state. If he does not succeed, the fear is that the nation will see an explosion of unrestrained, unrestricted Internet gambling of all types that could badly cut down on gambling junkets to Las Vegas and cut into the state’s tourist revenue.

“We’re trusting that Harry knows what he’s doing,” a top casino company executive told POLITICO. “If he doesn’t, we are so screwed.”

The issue, which had simmered for much of this year as Democrat Reid negotiated a bill with Sen. Jon Kyl (R-Ariz.), exploded into an unusual intrastate, internecine battle between Reid and Heller, a Republican.

Reid had earlier this year tasked the Silver State’s junior senator with rounding up 15 GOP votes to push legalized online poker, but not other forms of Internet gambling, then lambasted Heller publicly last week for failing to do so.

A Delhi court has ruled that online sports betting is an offence in India and websites hosting games of skill, like chess and poker, involving money cannot be given any protection under the constitution.

Additional District Judge (ADJ) Ina Malhotra, in an order passed Sep 17 and made available Monday, said that even games of skill offered by websites involving money cannot be held to be legal and banks can refuse to provide normal services to such websites.

On a petition filed by a company of former students of Indian Institute of Technology (IIT), the court said that gambling activities or conducting online games for profit on gaming portals were res extra commercium (a thing outside commerce) and could not be included within the words trade and business.

"Sports betting is an offence in India and bookies earning money from bets laid on games of skill cannot be granted protection under Article 19(1)(g) of the constitution (right to practise any profession or to carry on any occupation)," said the court.

The court's observation came on a petition seeking opinion on various aspects including wagering and betting on online games of skill.

The petitioner, an internet start-up company founded by an Indian Institute of Technology-Delhi alumni with other Internet experts, told that court that it was proposing to launch a website offering six games - chess, billiards, rummy, poker, bridge and snooker, recognised as "games of skill".

The company said that it planned to organise such games, which may amount to betting or gambling, and therefore sought an opinion of the court to ensure that they did not transgress or violate the laws before venturing into the area.

A local court in New Delhi, India’s capital city, has ruled that betting on skill games on the Internet isn’t lawful, Indo-Asian News Service reported this week. The ruling came after a company requested some guidance on the matter prior to potentially launching a product.

The start-up firm reportedly was looking to offer games such as chess, pool, poker and bridge on its site. Chess is widely considered to be essentially 100 percent skill-based.

India’s 1.2 billion population is spread out over 28 states and 7 union territories. The country, on a whole, has not been very receptive to the gambling industry, as it has a law dating back to 1867 that restricts the activity. Other prohibitions since then have also been pushed through.

As Nevada moves in the right direction for legal and regulated intrastate poker, three more companies have been approved for Internet poker licenses by the state. These and other companies will be ready to open when legislature allows online poker within the state and Nevada gives the green light on intrastate Internet poker.

The Nevada Gaming Commission approved slot machine fabricator WMS Industries of Waukegan, Illinois was approved for an online poker license as an interactive gaming system manufacturer and service provider.

The Spanish online poker regulator the DGOJ and its French counterpart ARJEL are set to sign an agreement to increase co-operation and share information regarding the regulation of online gambling, another step towards potentially sharing online poker liquidity.

Such agreements and Memoranda of Understanding are common between regulators to swap notes on effective online regulation and co-operate on issues such as player protection, security, and clamping down on unlicensed sites.

Online poker in Spain, France and Italy is regulated and taxed, and player pools are kept separated from international pools and either other. However, the regulators have met to discuss sharing online poker liquidity and another meeting is planned for December.

The Director General of the DGOJ, Enrique Alejo, said back in July that he was hopeful that a bilateral agreement between Spain and Italy could allow a shared player pool between the two countries as early as next year.

Regarding a France-Spain agreement, Alejo stated at the time that “the French are positive but have shown less willingness” to act in a similar timeframe. However, the announcement this week from ARJEL of bilateral talks shows a renewed interest in information sharing and could pave the way for a three-country deal.

Pooling liquidity is vital to sustain the longevity of online poker. Both France and Italy have seen a decline in activity of online poker, despite other online gambling revenue increasing. The unique format of poker suffers both from segregated markets, restricting availability of active games, and from high taxation strangling liquidity.

Casino owner, hyper-aggressive Republican campaign donor and web poker adversary Sheldon Adelson has fallen to 12th on Forbes’ list of America’s richest people, with a “net worth” of $20.5 billion. Adelson was listed as having $24.9 billion in a March ranking.

Despite losing some of his value for the moment, the 79-year-old has set a new record for political donations, Politico reported on Saturday. He has shipped more than $70 million so far to the Grand Old Party, and could give another $100 million in an effort to kick President Barack Obama, and other top democrats, out of power.

His wealth on paper has fluctuated greatly over the recent years. In 2008, the Wall Street Journal reported that he lost about 93 percent of his “investments” — or about $30 billion. However, it didn’t take long for the casino magnate to look flush again.

Adelson told Politico in the rare interview that he donates so much because others do too.

His casino company, Las Vegas Sands Corp., has not opposed legalizing online poker, but Adelson himself has stated that he’s “morally opposed” to such betting, the Las Vegas Review-Journal reported late last year. Sands’ main competitors in the industry, such as MGM Resorts International and Caesars Entertainment Corp., are seeking to run web poker in Nevada.

Adelson, described as a “self-made” businessman by Forbes, has been a big investor in the booming gambling markets overseas. Asia has yielded huge profits for his company.

The brick-and-mortar gambling market in the region dwarfs the worldwide online poker market. Web poker would likely be the only online real-money gambling allowed in the U.S., if a federal bill ever comes to pass. On the state level, Nevada is poker-only right now.

If the recent airing of the dirty laundry — including the trading of public insults between Sens. Harry Reid and Dean Heller — is any indication, the delicate effort to legalize online poker is mired in deep political quicksand.

While that show has been playing for the public, however, lawmakers are continuing to work on a backup plan, in which they hope to avoid explosive public fights altogether and quietly resolve the poker standoff behind closed doors.

And it appears Plan B — “or D or E,” as Reid Chief of Staff David Krone put it in an interview last Friday — may actually have been the plan all along.

Back in January, just a few weeks after the Department of Justice released an interpretation of the Wire Act that would inspire more than a dozen states to start pursuing their own Internet gaming ventures, Krone sat down to dinner with his then-counterpart in the House, Barry Jackson, former chief of staff to House Speaker John Boehner.

They came up with a plan, Krone said, in which Reid and Boehner could rein in that Wire Act reading while legalizing interstate Internet poker, all without too many fireworks.

According to a recent report on several media outlets, including CalvinAyre-com, four online poker sites on the Revolution Network will be moving to Juicy Stakes Poker on September 27th, 2012. Juicy Stakes is a poker skin of Revolution Gaming and the transition should be complete by tomorrow.

USA customers of Cake Poker, Fugu Poker, Colt Poker and Hilife Poker will now be playing on Juicy Stakes Poker. This change will mark the second time in just five months that Cake Poker has moved to a different network, however this is the first time the change involves United States customers. The Cake Poker Network was purchased by Lock Poker a few months ago and they rebranded the network to the Revolution network.

The article at Calvin Ayre’s website was created by Ed Drake and the article discusses the decision for the move as well as stating that the move seems to be quite strange due to the origin as well as the destination sites of Cake players. Drake wrote: “Typically, when a gambling operator wants to transition American players to another site, it’s to help insulate the larger entity and of course protect the players from unnecessary seizures of their money if the US government turns their eyes to the particular website.”

Drake further points out that Cake Poker is an EU site and should be untouchable by the US DOJ. So why would the poker network want to move the US players from a ‘safe’ site to the Juicy Stakes Poker option, especially since the site is a Dot com and not a dot eu site. Revolution has not released an official statement on the subject and it seems as though the affected poker rooms have yet to make the announcement as well.

It will be interesting to see how this story progresses. We will continue to monitor the situation and report any findings as they happen.
