Many people believe that the Minnesota Department of Public Safety went above their jurisdiction when they ordered Internet service providers to ban access to online gambling sites. The Interactive Media Entertainment & Gaming Association is now prepared to challenge the state in court.

One of the biggest betting companies in the UK is preparing to take the Dutch Government to court for placing what they have deemed to be unfair restrictions on Dutch banks attempting to process bet payments similar to the UIGEA in America.

Even in the 21st century, many shortsighted governments continue anti-gaming (and thus anti-poker) policies for no discernable reason other than habit, and lump poker in with ‘house’ games like roulette. Their knee-jerk arguments hearken back to a day when going and having a flutter was thought to be a one-way ticket to hell.

Today, folks know this isn’t the case, but government policies haven’t followed suit. In the UK, USA and many capitals throughout Europe, the people’s representatives haven’t realised that poker is not only an enjoyable and largely harmless activity, but it can also fill government coffers as well. In a classic case of governments overstepping their bounds, they miss out on billions of dollars – in return for which they get to tell grown, free-thinking adults what they can and can’t do with their hard-earned money.

While the UK and USA are acting like their money will never run out, at least one country is starting to get smart: Bulgaria. Officials from that nation recently gathered to brainstorm how Bulgaria can incorporate gaming into its tourism strategy, and how to find a ‘middle ground’ on online gaming.

“Gambling tourism is a resource Bulgaria has not exploited. A national gambling development programme needs to be drawn up as part of the tourism industry,” said Deputy Finance Minister Atanas Kunchev. It’s not rocket science – you promote what you have, whether it’s climate, beaches, culture or gaming. With a possible recession looming and many governments drowning in red ink, as they say in poker: “Don’t leave money on the table.”

Around the felt, that means don’t miss bets that you would have won. In government, it means don’t miss out on revenue that you could easily have had. Nothing these governments did stopped people from gaming on the Internet – all they did was miss out on billions in tax revenue that could have been used for the common good. And you can add the recent nixing of the ‘super casino’ to this list of mistakes.

There are fewer and fewer well-paying jobs around these days. We don’t need governments to protect us morally. We can do that ourselves, thank you. What we need governments to do is help protect us financially. And you don’t do that by leaving money on the table.

We noted several days ago that Minnesota was trying to force ISPs to block gambling web sites, going down a path trodden by several other states. That path, of course, has always ended in failure after the courts have weighed in. It looks like the courts will now get their chance to rain on Minnesotan politicians' parade, as a trade group has sued the director of the state's Department of Public Safety's Alcohol and Gambling Enforcement division to stop the ban. The group uses the suit to remind the director that he doesn't have the authority to mandate the blocking by ISPs, something the court will likely reinforce.

(Under new rules which were introduced in Russia in 2006, all gambling establishments are required to be relocated into one of four designated zones, which are to be established by June 1. The four zones will be situated on the Azov Sea, in the Far East and in the Altai and Kaliningrad regions, and any casinos operating outside of the four zones will be shut down).

The Dutch government's stubborn refusal to adopt European Union principles in protecting its state gambling monopoly continued to generate problems for the country this week as Betfair launched a legal attack and the European Commission ordered an investigation into possible non-compliance with EU treaty requirements.

(A survey in January said the Dutch are spending Euro 450 million a year on 'illegal' internet gambling).

Salman Waris who is head of Technology Law Practice of FoxMandal Little and a cyber law and crime expert has this to say about the online gambling scene in India: Most gambling web sites are located offshore making enforcement difficult though the Indian IT Act which has extra-territorial jurisdiction with regard to computer-related offences committed in India. Out of the reach of Indian laws, many of the websites are hosted in countries where gambling and betting is legal. Evidence is routinely shredded as part of housekeeping,so commonly there is no data to support prosecution. Blocked web sites just change their addresses and are in business again.

(The Indian Government has not been able to come up with specific laws by amending the Public Gambling Act or making the IT Act cover online gambling both directly or indirectly).

Claudine Williams, the first woman to run a Strip casino and considered one of the pioneers who shaped the gaming industry and Las Vegas, died Wednesday after a long illness. She was 88.

(Williams was born on March 17, 1921, in DeSoto Parish, La. When she was 12 years old, Williams worked as a waitress in a restaurant that catered to oilfield workers. She got her first casino job when she was 15, dealing cards at a private club in Bossier Parish that offered gambling).

Two issues enjoyed majority support in the poll – allowing doctors to prescribe marijuana for medicinal reasons and legalizing casino gambling in the state.!!
