A second casino has been granted permission to launch online poker and gambling when the industry goes live in New Jersey next month. The Golden Nugget Casino, which partnered with Bally Technologies to offer online gambling to customers, was informed by authorities on Thursday that it had received approval after applying for an online gaming license.

The Golden Nugget’s approval was received shortly after the Borgata Casino became the first resort to receive approval from the New Jersey authorities.

If all goes according to plan, all those casinos that receive approval from the state regulators before November 21st will be able to run a five day trial of their online casino sites and then go live on the proposed deadline of November 26th.

“All players that desire to gamble online deserve a fair and trustworthy experience,” said Tom Pohlman, the Golden Nugget’s vice president and general manager. “Rest assured, that is our customer commitment, and unlike others, we have an Atlantic City land-based casino to stand behind our online brand.”

The new online gambling products are set to provide a life line to the struggling New Jersey casinos, who have seen their revenue drop from $5.2 billion in 2006 to a dismal $3 billion in 2012. The state governor realized that the only way to save the state’s gambling industry was to move ahead with plans to introduce online gambling, and the process has been very short and focused. New Jersey also realized that it needs to compete with other states such as Nevada and Delaware who have also introduced online gambling legislation.

Analysts have predicted that within a decade, New Jersey’s online poker market could be worth $100 million, and has the potential to make $65 million in its first year of operation.

A national survey conducted on behalf of Las Vegas Sands Corp. found that 67 percent of those questioned are opposed to legalizing Internet gaming.

Among the findings from the poll directed by The Tarrance Group earlier this month was that 62 percent of those surveyed approved of having various forms of gambling in their respective states as a way of generating tax revenues.

However, the polling found sound opposition to Internet gaming. More than 58 percent of the respondents favored the current federal ban on the activity.

“People are not opposed to casinos, but they just believe they shouldn’t be on on everyone’s phone and computer,” said Las Vegas Sands Vice President of Government Relations and Community Development Andy Abboud.

The Tarrance Group, which is headquartered outside Washington, D.C., in Alexandria, Va., works as a pollster on behalf of Republican candidates. The telephone survey polled 1,000 likely registered voters across party lines from all 50 states between Oct. 14-17. The survey had a 3 percent margin of error. Both landline and cellphone users were polled.

The poll was conducted in the manner of a survey used for a presidential campaign.

Those surveyed were asked whether or not they had a positive or negative view of seven forms of gaming. State lotteries had the highest positive rating at 71 percent. Horse racing tracks has a 58 percent approval while Las Vegas style casinos had a 56 percent positive rating. Internet gambling had the highest negative rating at 67 percent.

The survey also asked a variety of questions covering voters perceptions on Internet gaming.

“While voters support the concept of using gambling to generate revenue and have generally positive views about existing forms of state approved gambling, there is a sharp divide when it comes to Internet gambling,” The Tarrance Group wrote in a memo to Las Vegas Sands executives. “Internet gambling, even Internet poker, is seen as a much different form of gambling and is seen in a much more negative light. Even experienced gamblers have qualms about this form of gambling.”

Las Vegas Sands Chairman Sheldon Adelson has been the casino industry’s most vocal opponent against any effort to legalize Internet gaming on federal level. His approach has differed from others in the casino industry, including MGM Resorts International and Caesars Entertainment Corp.

The Washington, D.C.-based American Gaming Association, the gaming’s trade group and federal lobbying arm, supports Congress passing poker-only federal legislation. Las Vegas Sands President Michael Leven is a member of the Association’s board.

Association representatives declined comment on the Las Vegas Sands poll.

In June, Adelson, who had previously raised moral objections to Internet gaming, wrote a commentary that was published on Forbes-com in which he said online wagering technology didn’t provide enough safeguards against underage gambling and problem gambling.

In his Forbes-com commentary, Adelson used phrases such as “fool’s gold” and “societal train wreck” to describe online gambling. He said the activity could bring a “plague” to society.

Abboud said the survey’s findings “help back up” the company’s belief that most Americans don’t favor legalizing Internet wagering. Abboud said the survey would be used when Las Vegas Sands officials discuss Internet gaming matters with lawmakers on both state and federal level.

“We have a stated position that has always been in opposition to Internet gaming,” Abboud said. “As long as the issue is being pushed, we will respond accordingly.”

Nevada, Delaware and New Jersey have enacted Internet gaming laws. In Nevada, two real money online poker websites are accepting wagers over the Internet. Delaware is expected to launch online poker next week and New Jersey plans to launch Internet gaming by end of November.

In the U.S., Las Vegas Sands operates casinos in only Nevada and Pennsylvania, which is one of several states exploring Internet gaming legalization. In a separate survey for Las Vegas Sands, The Tarrance Group found that 69 percent of the Pennsylvania respondents had a negative view of Internet gaming.

With exactly one month remaining before the launch of real money online wagering in New Jersey, it seems that the media and industry pundits are possibly more excited about the upcoming start date than are bettors from the Garden State.

New Jersey became the third state in the U.S. to pass a law green-lighting Internet-based wagering behind Nevada and Delaware when it did so last February.

It will, however, be the second state to see its nascent online betting market go live. Nevada – where only online poker is permitted – launched its first real money online poker room, Ultimate Poker, last April. The second, the World Series of Poker-branded web site WSOP-com, followed suit in September.

In Delaware, which like New Jersey will allow online casino games and other forms of Internet betting in addition to real money online poker, an official go date has not been announced, but games are expected to be accessible there before the year is out.

Five casinos have received permits from state regulators

The terms of New Jersey online gambling law dictate that the industry be connected to land-based casinos in Atlantic City, a mandate that has resulted in the announcement of a slew of partnership deals between brick and mortar New Jersey casinos and online operators, a good number of them offshore gaming companies.

Those operators must be licensed separately from the land-based casino with which they’ve entered into agreements, and so far we have not seen any such permits issued by New Jersey gambling regulators. Five casinos have been approved; the Borgata, the Golden Nugget, the Trump Taj Mahal, the Trump Plaza, and the Tropicana have all been cleared to begin offering games to New Jersey residents when the marketplace commences on November 26 at 9 in the morning.

It should be noted that despite the shared name, Trump Plaza and the Trump Taj Mahal are managed separately and therefore have entered into distinct partnership deals. The Taj Mahal has teamed up with Ultimate Gaming, parent company of Nevada online poker room Ultimate Poker, while the Plaza has entered into an iGaming agreement with international gaming company Betfair.

The Tropicana is the most recent addition to the list of approved casinos, having only received word of its licensing this week.

Seven Atlantic City casino properties remain unlicensed

Of the twelve land-based casinos in New Jersey’s gambling mecca of Atlantic City, more than half have yet to receive approval from state regulators. Two properties in the city – incidentally two of the most financially struggling – have not publicized partnership deals or expressed plans to enter the state’s iGaming industry.

Revel, which emerged from bankruptcy last Spring and has undertaken an somewhat aggressive re-branding from a luxury property to one that is meant to cater to the more traditional Atlantic City tourist, to date remains without a partnership deal in place.

So too does the Atlantic Club Casino Hotel, which made headlines earlier this year after backing out of a deal with the parent company of online poker giant PokerStars, Isle of Man-based the Rational Group, that would have seen PokerStars taking over the ailing locals casino. A judge went on to uphold the Atlantic Club’s right to terminate the deal, even permitting the casino to keep $11 million that it had received from PokerStars toward a total $15 million purchase price.

That defeat did not prevent PokerStars from finding another way into the New Jersey market, as the company soon made it known that it had instead paired up with Resorts, the oldest casino property in Atlantic City.

The fact that PokerStars has yet to be awarded an operating permit by New Jersey officials has been much fodder for discussion, as there remains a debate in the industry with regard to so-called “bad actors” who continued to operate U.S.-facing real money online poker after the 2006 passage of the Unlawful Internet Gaming Enforcement Act. While some believe that PokerStars is well-qualified to operate in the regulated marketplace, there are others who believe that any company that offered real money games to U.S. players post-UIGEA ought to be barred.



New Jersey Real Money Internet Betting to Launch in a Month

State approvals announced Friday all but guarantee that several Atlantic City casinos will be prepared to offer online gambling by the Nov. 26 launch.

The New Jersey Division of Gaming Enforcement released a list of companies that have been awarded waivers, authorizing them to engage in Internet gambling activities later this month. A trial period begins Nov. 21.

The waivers indicate that the companies have submitted complete applications and have passed preliminary investigations. A license will still be needed to operate in New Jersey in the long term, according to state guidelines. The casino entities offering Internet gambling also have to receive online gambling permits in the state's multi-tiered process.

Five casinos already awarded permits saw waivers approved Friday for their operations and their Internet gambling partners.

Among those approved for operation Friday were Borgata Hotel Casino and Spa and its partner bwin.party, Tropicana Casino and Resort and its Internet partner Gamesys Limited, Trump Taj Mahal Casino Resort and its partner Ultimate Gaming, Trump Plaza Hotel and Casino and its partner Betfair, and Golden Nugget Atlantic City and its partner Bally Technologies.

The four Atlantic City properties owned by Caesars Entertainment - Caesars, Ballys, Showboat and Harrah's - have not yet received Internet gambling permits. But on Friday Caesars Atlantic City and was approved for a waiver with partner Amaya, and Bally's Atlantic CIty was approved for a waiver with 888 Holdings.

Absent from Friday's list was PokerStars, the online gambling giant that faced difficulties in New Jersey's licensing procedures while it was trying to obtain authorization to purchase the Atlantic Club Casino Hotel. That deal later collapsed, leaving PokerStars announced plans to team up with Resorts Casino Hotel to offer online gambling.

That does not necessarily mean PokerStars won't receive a waiver before the online gambling launch, as the list will continue to be updated, said Lisa Spengler, a spokeswoman for the New Jersey Division of Gaming Enforcement. PokerStars' application is still under review, said Spengler. The division would not release any additional details on the status of pending applications.

After a week-long soft launch, iGaming is officially up and running through Delaware’s casinos’ websites as of Friday.

About 123 players are registered to online gamble in the state, lottery officials said, and they expect the number to only go up.

“It’s a layered process,” said Vernon Kirk, Delaware State Lottery director. His agency is responsible for regulating the activity, reconciling accounts and acting as a liaison for vendors that handle payment processing.

The officials have found that when players with Visa credit or debit cards attempt to deposit money to their iGaming account, their transfers, most of the time, have not been approved since the banks carrying Visa cards do not have a universal code for online gaming. Mastercard, on the other hand, has a special code for gaming transfers, Secretary of Finance Tom Cook said.

In order to register online, players must plug in their cell phone number so the system can verify their geolocation. Secretary Cook said there have been minimal geolocation problems, with the only issues arising with individuals who live close to the Pennsylvania border.

Overall, they are content with the progress, even though it is not expected to be a large revenue source for the state.

Per the iGaming legislation, signed by Gov. Jack A. Markell in June 2012, the revenue sharing model was modeled after the current video lottery revenue sharing model. The first $3.75 million iGaming revenue will also go directly to the state. Secretary Cook said the revenue projections for Fiscal Year 2014 could potentially amount to $5 million.

“Revenues are going to be really modest,” the secretary said.

However, the agencies could see a potential boom when iGaming moves to mobile phones and tablets at the end of 2014. Secretary Cook said he envisions iGamers at the beach, reclining in the sand and playing online poker on their iPads.

“Social media is going to play a big role in this,” he said.
