The Northern Territory and Norfolk Island are potentially being used to legally avoid tax because of laws that tax companies in the jurisdiction where they are licensed, not where the bet is placed, the South Australian Council of Social Services says.
"When a gambling corporation does not have to be incorporated or resident in a jurisdiction, but can still use the licence of a jurisdiction like Norfolk Island to lessen their taxes, I think we have gone beyond real business and are talking about virtual tax havens and (legal) tax avoidance," chief executive Ross Womersley said.
"Because of the way the licence arrangements are made, South Australia is missing out on a whole lot of tax income."
Mr Womersley called for a national agreement on online gaming taxation based on where the gambling occurs, not where the company is licensed.
"Given that the gambling industry generates a high level of problems, major issues in our community, we think that it's absolutely important that the industry meets its social responsibilities in the form of taxation," he said.

Last week, the Danish government revealed that it was mulling a sale of Danske Spil’s online gambling operations, including its online betting, poker and casino business, while keeping its lottery business under state control.
Brian Mikkelsen, deputy chairman of the Conservative parliamentary group, told Danish business media outlet Borsen that selling Danske Spil’s betting business would be as easy as snapping one’s fingers. Mikkelsen suggested a sale could be finalized within one year of the business being officially put on the block.
Some observers have estimated that the state could realize up to DKK 3b-4b (US $460m-613m) via the sale, a not insignificant sum for any government looking to plug budget gaps.
But opposition politicians have criticized the proposal to sell out, noting that whatever short-term gains the government realizes will pale in comparison to the steady stream of annual income the state would be giving up. Danske Spil generated a profit of DKK 743m for the state in 2015.
Critics have also suggested that putting the country’s leading betting operator into private hands could lead to a change in ethos at Danske Spil, including the imposing of betting limits on sharp bettors.
Danske Spil held a complete monopoly on all things gambling in Denmark until the country opened up its market to international online operators in 2012. While not entirely successful in convincing Danish punters to patronize state-licensed sites, the liberalization has been held up as a model for other markets looking to transition from a state-run monopoly to a more open system.
Case in point: Sweden is preparing a new gambling framework that is expected to call for the privatization of its Svenska Spel gambling monopoly and a transition to a more open online gambling marketplace.

The study comes from the 2012-2013 Youth Gambling Survey conducted in conjunction with the Canadian Youth Smoking Survey in three provinces, Newfoundland and Labrador, Ontario and Saskatchewan and was completed by a total of 10,035 students in grades nine to 12 (aged 13-19). Results showed a prevalence in online gambling that was significantly higher than determined by previous studies, finding that 9.4 per cent of teens reported gambling online during the past three months and a total of 41.6 per cent reported having gambled money or something of value in either offline or online gambling, with differences between the three provinces found to be negligible.
“This study clearly shows that many youth are gambling online despite restrictions,” say the study’s authors. “Further restrictions and harm reduction approaches are needed to ensure that the wide availability of online and simulated gambling does not lead to increases in problem gambling.”
The study found that for Canadian teens, popular gambling activities included dares or challenges (22 per cent), instant-win or scratch tickets (14 per cent), games of skill such as pool or darts (12 per cent), offline sports pools (9 per cent) and card games such as poker or blackjack (9 per cent). Gambling on the outcome of video games emerged as an area of concern, with 14.5 per cent of males and 5.1 per cent of females reporting that they engaged in the activity.
“The lines between gambling games and video games have become blurred as technology has changed,” say the authors. “Researchers have therefore become concerned that engaging in gambling with video games may increase the likelihood that gambling is viewed as more socially acceptable, may increase positive attitudes towards gambling, and could potentially increase the likelihood of problem gambling in the future.”
The researchers note that research on online gambling is still at an early stage, and given the increasing legalization of online gambling, more work is desperately needed on the topic. (Four Canadian provinces have legalized online gambling -Ontario, B.C., Manitoba and Quebec.)

According to figures released Wednesday by Garden State gaming regulators, online poker revenue in March was $2,461,064, up 10.5 percent from the $2,227,629 in March 2015. The year-over-year increase ends a long period of decline and stagnation for the state’s online poker market.
If you add in the other authorized online casino games, Internet gaming win was $15,507,459 in March compared to $13,165,623 in the same month a year prior, reflecting an increase of 17.8 percent. That’s the most in overall I-gaming win the state has seen since the games first debuted in late 2013.
New Jersey Internet gaming win was roughly $14.7 million in February.
Through the first three months of 2016, online gambling win was up 27.7 percent to $44,887,151. Peer-to-peer poker play was $6,606,361, up 0.5 percent year-over-year.
PokerStars launched its core product, along with a handful of other casino games, in New Jersey on Mar. 21. The platform partnered with Resorts casino.
Resorts Digital had online gaming win of $1,878,097 this March, compared to just $154,071 in March 2015.
Borgata ($4,226,855), Tropicana ($3,169,063), Caesars Interactive NJ ($3,163,357) and Golden Nugget ($3,070,087) all saw year-over-year gains in March as well.
After just one week in New Jersey, PokerStars was the most-played regulated online poker site in the state in terms of cash game players.
New Jersey is one of three states in America with regulated online casino games. It controls more than 90 percent of that market in the United States.

Santiago Asensi, an expert attorney in gaming and gambling law, said the industry is looking particularly at three countries—Mexico, Brazil, and Colombia.
“They’re focusing in Mexico, which is about to approve a reform in the gambling act. Brazil, who’s also about to pump up and regulate gambling finally, and particularly Colombia,” Asensi told CalvinAyre-com.
Many governments in Latin American continued to have outdated laws that address online gambling. Colombia, however, is different, according to Asensi.
“[The] Coljuegos, which is the regulator there, has powers in order to approve their own regulations so the regulation will definitely not be sent to Congress and discussed there, whatsoever. It will be the same regulator the one who will approve them,” he said.
Asensi also noted that Colombians have a healthy appetite for gambling, making the country a prime market for online gambling operators.
“[It’s] a jurisdiction with a lot of interest in terms of population. They have their own particular games like Baloto, like some kind of lotteries, a lot of lotteries like Keno, but at the end of the day, most of Colombian like [the] same casino games [and] sports betting that Europeans like,” Asensi said.
In comparison, Brazil—also an area of interest for online gambling operators—continues to have a slow bureaucratic system that has yet to pass a legislation for national reform regarding gambling.
“Things are going slower there than in other jurisdictions,” Asensi said. “I believe that we’ll need to wait and see, but right now it’s too early. It’s in very preliminary stage, everything.”

On Thursday, five Michigan state senators, led by Sen. Mike Kowall (pictured), introduced SB 889, aka the Lawful Internet Gaming Act. The bill seeks to “protect residents of this state who wager on games of chance and skill through the internet and to capture revenues and create jobs generated from internet gaming.”
The list of legally permitted online games has yet to be fully fleshed out, but sports betting won’t be among them in order to avoid conflicts with the federal PASPA sports betting prohibition. Online gambling would be limited to individuals 21 years of age or older.
The state plans to issue no more than eight online gambling licenses to either state-licensed private casino operators or federally recognized tribes with existing casino operations in the state. Tribes will have to waive their sovereign immunity and pay the relevant taxes and fees in order to qualify. Institutional investors who hold less than 30% of an applicant’s equity are exempt from the application consideration process.
Online gambling licenses will cost $5m upfront, although this will serve as a deposit against future online gambling taxes, which will be imposed at a rate of 10% of gross gaming revenue, payable monthly. Licenses will be valid for five-year terms, with five-year renewal options, and applicants must submit a non-refundable fee of $100k.
Online gambling technology vendor licenses are also good for five-year terms, but the specifics of who might qualify for a vendor license have yet to be nailed down. The legislation makes no reference to any so-called ‘bad actor’ prohibitions on companies that may have done some US-facing business when such activity was considered legally sketchy.
The bill would allow the state to enter into agreements with not just other US states but also “foreign entities” to allow “multijurisdiction internet gaming to the extent consistent with state and federal laws and the laws of any foreign jurisdiction.”
This includes allowing wagers from individuals not physically present in Michigan, which presumably allows for the possibility of Michigan residents being able to access gambling sites based in other countries with which the state has entered into reciprocal agreements.
Michigan pols already have some experience with online gambling, as Michigan is one of only three US states that allows some form of online lottery sales, and Michigan is one of only two states that permits instant win online games. This weekend, the Economic Observer quoted an anonymous industry insider saying that Beijing authorities were preparing to authorize a trial of a new online lottery regime, but only after the government crafts the necessary regulations. The source offered no timeline for when these new regulations might be ready.
Beijing ordered a ‘temporary’ suspension of online lottery sales in March 2015 after government audits turned up widespread evidence of fraud by officials at provincial lottery administration centers. The suspension contributed to the 3.8% decline in China’s lottery sales in 2015.
No company was ever officially approved to sell sports and welfare lottery tickets online in China, although the government had allowed two companies – 500-com and Sporterry.cn – to participate in an online pilot program.
The lack of authorization didn’t stop numerous other internet businesses, including internet giants Alibaba and Tencent, from offering online lottery sales. The suspension has cost all these companies, but 500-com has been hit hardest, reporting three straight quarters of zero revenue.
Last month, Hong Kong-listed lottery technology firm AGTech Holdings issued its annual report, in which CEO Sun Ho said he expected Beijing to approve “new online and mobile channels for lottery sales” this year. The Australian website of the Malta-based Unibet recently trumpeted the fact that punters can now take advantage of its “NEW LIVE BETTING!” offering, which is currently available for Chrome and Firefox browsers but the site promises the function will be “arriving soon on the Unibet App.”
Unibet’s voice-activated live-betting system mimics the smartphone apps launched by bookmakers William Hill, Ladbrokes, Bet365 and Sportsbet, despite lingering questions over the legality of such systems under Australia’s 2001 Interactive Gambling Act (IGA), which allows remote in-play wagering only via the telephone.
The Australian government is sitting on a report detailing its review of the IGA, which includes whether or not the government should relax the online in-play prohibition. But Australia is expected to face a federal election later this year and the government is reportedly not keen on appearing to be expanding gambling options given that polls have shown it’s a vote-loser.
EMUCASINO ACCUSED OF MISREPRESENTING DOMAIN OWNERS
Meanwhile, Emu Group Ltd, a Malta-registered, Curacao-licensed, Australian-facing online casino brand, has been accused of improperly identifying the owner of its Aussie website domain.
According to research conducted by The New Daily, the Emucasino-com.au domain is registered to Jeff Muller, a Gold Coast hairdresser. Contacted by The New Daily, Muller claimed to have never heard of the website and disavowed any connection to Emu Group.
Muller said he’d hired a solicitor to figure out how to get his name expunged from the registry. Australia’s domain administrative body auDA has the authority to shut down websites if it determines that the sites were fraudulently registered.
The Emu Group websites proudly claim to have been “created by Australian’s [sic] for Australians across the globe.” The Group’s official Facebook page lists 10k subscribers from Australia and The New Daily reported that the EmuCasino site lists phone numbers for customer service centers in Sydney and Auckland.
This is the second time in a week that The New Daily has put international online casino operators in its sites. On Thursday, the site had a go at Australia Post’s connections to payment processing for international online casino sites. Australia’s IGA allows for online sports betting but online casino and poker sites are prohibited.

Authored by State Senate Majority Leader Mike Kowall (R-District 15) and four other state senators, three Democrats and one Republican, Senate Bill 889 states that the “Internet has become an integral part of everyday life,” and that “Internet wagering on games of chance and games of skill is a core form of entertainment for millions of individuals worldwide.”
“It is in the best interest of this state and its citizens to regulate this activity by authorizing and establishing a secure, responsible, fair, and legal system of Internet gaming that complies with the United States Department of Justice’s (DOJ) September 2011 opinion,” the bill reads.
The 2011 DOJ opinion declared that the longstanding Wire Act that prevented payment processors from facilitating transactions for Internet wagering was misinterpreted, and that the law applied only to online sports betting and not general gambling.

There was also an impressive $5.5 million spent on online table games which resulted in revenue of $68,420.
The figures are excellent news for proponents of online gambling as revenue figures have not been as high as expected. If the current trend continues then the state can expect to bring in significant amounts of money over the coming years.

On Wednesday, the Bernama news agency reported that the Malaysian Communications and Multimedia Commission (MCMC) had ordered local telecom firms to cancel over 8k phone numbers for promoting illegal gambling operations via Short Messaging Services (SMS).
Deputy minister in charge of communications Datuk Jailani Johari said the government had been forced to act after receiving over 400 complaints regarding the gambling text messages since last year. Jailani added that the government had forwarded the offending phone numbers to the police for further investigation.
Last August, the MCMC claimed the rise of SMS gambling promos was an indication of the success the government was having in stamping out illegal gambling websites. Through February of this year, Malaysia claimed to have blocked 399 such sites, putting it on pace to surpass the 2,200 sites it suppressed in 2015.
In February, local NGOs had publicly called on telecom providers to “take proactive measures” to curb SMS gambling come-ons, suggesting they should follow the lead of the banking sector by requiring new users to register mobile phone numbers using fingerprint authentication to ensure the authorities knew who was using the accounts.
Responding to a senator’s inquiry as to what special measures the government was taking to combat illegal gambling operations, Jailani said the MCMC was working in close connection with other ministries as well as Malaysian financial institutions to disrupt the flow of illegal gambling proceeds.
Last month, Malaysia’s deputy prime minister announced that the government would rewrite the nation’s gambling laws to allow for harsher penalties for illegal gambling operators, with a particular eye toward online operators.

On Monday, the Malta Gaming Authority (MGA) announced that it had “no connection with betmod90 The MGA offered no details on its announcement, saying only that any references on the Turkish-facing Betmod90 site to being licensed by the MGA were “false and misleading.”
On Thursday, the MGA announced that it had suspended the remote gaming license of GLX Services Ltd. Here again, the MGA offered no further information on the rationale behind its decision, except to say that its silence was justified so as “not to compromise any investigations that may need to be performed” by the MGA “and/or any other competent authority.”
The MGA did say that sites operating under the MGA/CL2/432/2007 license were to “immediately suspend all gaming operations,” stop registering new customers, suspend all website transactions and to submit all data and documentation requested by the MGA.
The MGA/CL2/432/2007 license had previously been listed under the name Yosware Limited, a Malta-based company whose associated domains included Gobet33-com, Yosplay-com and Gamejoins-com. A search indicates that Gamelux-branded sites also cite this MGA license number.
Most of these sites appear to be focused on the Italian market, opening up the possibility that the suspension could have something to do with that country’s recent bust of illegal online gambling operations, although none of the above sites have so far been cited by Italian authorities in relation to last week’s police action.
A similar Italian bust last summer led the MGA to suspend the licenses of several Italian-facing operators, which prompted the affected licensees to threaten legal action if the investigation turned up no evidence of chicanery. One year later, the suspended licenses have yet to be reinstated.
