Daily fantasy sports operators got a rare opportunity to celebrate on Wednesday as Virginia legislators approved a bill to regulate DFS.

On Wednesday, the Virginia General Assembly approved SB 646, aka the Fantasy Contests Act, which now requires only Gov. Terry McAuliffe’s signature to become law. The vote marks the first time a pro-DFS bill has progressed to this stage since the industry imploded last October.

SB 646 requires DFS operators to pay a $50k registration fee, while registered DFS sites must ensure that all their players are over 18 years of age and that player funds are segregated from operating capital. Operators must also submit to an annual audit by the Department of Agriculture and Consumer Services.

SB 646 exempts DFS from the state’s list of illegal gambling no-no’s, but the bill’s language arguably authorizes other types of ‘skill-based’ contests involving sporting events – such as prop bets – that could lead the federal government to conclude that the state is in violation of the 1992 PASPA sports betting prohibition. But for the moment, anyway, it’s progress.

NEW YORK DFS BILL SETS HIGH HURDLE FOR ENTRY
This week saw DFS operators DraftKings and FanDuel file their latest paperwork in their legal fight for survival with New York Attorney General Eric Schneiderman, who ordered both companies to cease & desist operations in his state last November based on his belief that they’re illegal gambling operators under state law.

This week also saw New York state Sen. John Bonacic throw DFS a lifeline by introducing a new bill to regulate the activity. Bonacic’s S 6793 (read it here) would exempt DFS from the state’s definition of gambling activities and establish a Fantasy Sports Contests Division within the Financial Frauds and Consumer Protection Unit.

Unlike other DFS ‘consumer protection’ bills, S 6793 establishes a tax rate on DFS revenue. New York-approved operators would pay 15% of revenue derived from New York players and operators would need to submit a $500k deposit against future tax obligations, a hurdle that could preclude smaller DFS operators from horning in on DraftKings and FanDuel’s turf.

S 6793 would bar DFS operators from offering contests on college sports or horseracing events. Players would have to be 18 years of age or older to play, and operators would have to establish an undetermined maximum number of entries any DFS player could enter into a single contest.

Operators would have to segregate player funds from operating capital and shield player funds from being swallowed up by operator bankruptcy, financial risk and criminal or civil damage claims.

S 6793 stands a much better chance of progressing than the state’s other DFS bills, in part because Bonacic chairs the state Senate Racing, Gaming and Wagering Committee. Bonacic is also backing a new online poker bill that received a favorable vote from his committee earlier this month.

Denmark’s regulated gambling market closed out 2015 on a high note, with significant growth in licensed online gambling operator revenue.

Figures released this week by Danish gaming regulator Spillemyndigheden showed combined sports betting and online gambling revenue rising 21% to DKK 910m (US $134.4m) in the three months ending Dec. 31, 2015. Spillemyndigheden started 2016 with 15 licensed betting operators and 35 licensed online casinos.

Betting was both the largest vertical and Q4’s biggest gainer, rising nearly 32% to DKK 560m. For the year as a whole, betting revenue improved 14% to DKK2.03b.

Sadly, Spillemyndigheden doesn’t break out separate numbers for online and land-based wagering. Regardless, the betting market picked up speed throughout the year, having posted average quarterly growth of between 5-10% over the first nine months of 2015.

Online casino revenue was up 25% year-on-year to DKK 350m, marking the fourth consecutive quarter that the casino vertical has risen by at least 20%, compared to average quarterly growth of around 10% in 2014.

By contrast, the lifeless online poker vertical mirrored the global market by reporting DKK 40m, flat year-on-year and having shown no movement in any direction for the final nine months of the year. Poker’s total revenue for 2015 was down 25% from its DKK 220m peak in 2012, the year the regulated market launched.

The approximately 25,500 gaming machines in Danish halls and restaurants reported revenue of DKK 385m in Q4. While this number improved by only 2% from Q4 2015. It extended the vertical’s growth streak to four quarters. Total machine revenue through 2015 was DKK 1.55b, up around 3% from 2014.

Revenue at Denmark’s seven licensed casinos fell 6% to DKK 80m in Q4, although the total for 2015 rose nearly 5% to DKK 340m.

The nation’s total gambling market is expected to rise nearly 8% to DKK 8.35b, while spending per adult Dane is up 8.5% to DKK 1,900 ($281).

Between now and 2020, the global online gambling market is expected to see a compound annual growth rate of nearly 11 percent, according to analysis released late last year from research group Technavio.

The global online gambling market is currently worth around $37 billion a year, as about 85 nations across the world have chosen to legalize Internet gambling, according to the American Gaming Association. The healthiest online gambling market in Europe belongs to the United Kingdom. According to the most recent estimates, there are more than 18 million online gambling accounts in the U.K. alone, spread across dozens of sites, including InstaCasino. According to the United Kingdom Gambling Commission, between 2009 and 2005 online slots play increased 328 percent, while table games and poker grew by 52 and 26 percent, respectively.

A study conducted by the Swedish consultancy firm Mediavision has found that the youth of Sweden prefer online gambling to the more traditional gambling that the older generation enjoys. Further differences show that young Swedes prefer electronic sports, online casinos and online poker, whereas older Swedes prefer lotteries and betting on horse racing.

Sweden has a fairly high population of gamblers, with an estimated 40% of Swedes between the ages of 18 and 74 participating in some sort of real-money gambling on a monthly basis. Federal MPs are being warned that liberalising online gambling laws — including allowing in-play betting — will cost the Coalition votes at the election, with leaked polling showing the extent to which voters dislike internet gambling and its proponents.

It comes as one federal minister described liberalising gambling laws on the verge of a tightly contested election as “madness” and said the public wanted more regul******ation, not less.

“The idea of watering down online gambling laws and allowing high-volume online in-play sports betting — turning every mobile phone into an online poker mach******ine — is not politically smart at any time, let alone an election year,” the minister said.

The Crosby Textor polling, which has been distributed to a host of federal MPs and seen by The Australian, aims to increase pressure on the government to close the loophole allowing foreign******-owned bookmakers to circumvent the law and offer in-play betting to Australians via comput******er or smart phone using technol******ogy that emulates a phone call.

The research, done by the Coal******ition’s own pollsters, shows that 35 per cent of voters would be less likely to vote for the Coalition if it legalised in-play betting.

On the flip side, 33 per cent of voters would be more likely to vote for the government if it strengthened the law and the enforcement of it, according to the poll. The minister who spoke with The Australian said it was clear there was absolutely no upside for the government in helping foreign-owned online bookmakers and executives, nor “greedy” sports bodies pushing for in-play liberalis******ation.

“Even gamblers do not like these guys,’’ he said. “Why should parliament lift a finger to help Tom Water******house and a couple of UK and Irish bookies make more money? It is simply ludicrous.

“The fact that the greedy professional sports codes want to raise money from turning sportsmen and sportswomen into gambling commodities makes a lot of people uncomfortable.

“They already have billion-dollar****** TV rights deals and get everything they want from government, including new stadiums worth hundreds of millions of dollars.”

The release of the polling comes as anti-liberalisation forces — including the racing industry, pubs and clubs, and major listed gambling players Tatts and Tabcorp — are increasingly confident that they are winning the battle with their foreign-owned rivals over the future of live betting.

An adviser to an established Australian-owned betting company said that after close to 50 meetings with MPs and senators in the past three weeks, they were yet to find one politician who supported introducing online in-play sports betting. “The reality is that the foreign-owned corporate bookies backed by ‘big sport’ have probably won over some policy purist bureaucrats and a handful of advisers,’’ he said.

“However, they have simply not been able to convince those that matter, the elected officials. Why? Because these types of gambling products simply don’t pass the smell test.”

The so-called corporate bookmakers — such as British-owned William Hill, Ladbrokes and Bet365 and Irish-owned Sportsbet — see in-play betting as a lucrative new frontier.

But Australian Hotels Association chief executive Stephen Ferguson said the polling showed that prospect made voters “aghast”.

“The survey accords with what many politicians are thinking. Liberalisation of in-play betting is not something that sits well with a lot of them,” he said.

Human Services Minister Alan Tudge, with input from Commun******ications Minister Mitch Fifield, is putting the finishing touches on the government’s proposed reform******s to online gambling laws, to be released in coming weeks.

The survey showed 73 per cent of voters****** would support the government enforcing the in-play rules more vigorously and 65 per cent would support closing the loophole, while 61 per cent would oppose any move to make in-play betting online fully legal.

Loto-Quebec’s online gambling site is on track to smash its previous revenue record following another quarter of double-digit growth.

The Canadian province’s gambling monopoly reported a one-third rise in revenue at its Espacejeux online division in the first nine months of its 2015-16 fiscal year. Espacejeux revenue is up 33.2% to C$46.2m (US $34.4m), only $2.7m less than the sum earned during the full 2014-15 fiscal year.

Sadly, that’s the extent to which Loto-Quebec details its online operations, outside of saying its database of registered customers is growing larger every week (now believed to total around 16k). Informative, huh? There’s just nothing like the kind of public accountability one gets from a publicly funded monopoly.

Loto-Quebec credited the rise to a “significant improvement” to its online offering. The monopoly announced a boost in betting payout percentages at its Mise-o-jeu online and mobile parlay sports betting operation in December. Mise-o-jeu also recently announced it was taking prop wagers on the US presidential election, following the lead of other provincial monopoly sites.

The online growth significantly outpaced the rise in Loto-Quebec’s overall revenue, which gained 6.5% to $2.65b in the first nine months of the 2015-16 year. Profits were up 12.1% to $945.8m, putting the monopoly on track to exceed its annual target of $1.15b.

Loto-Quebec’s mainstay lottery operations reported sales up 11.4% while net income rose 28.2% to $358m. Casino revenue improved by 2.1%, boosting profits by 9.3% to $155.4m.

Other land-based gaming establishments reported profit up 2.4% to $432.5m, although the individual components reported mixed results. Game room revenue was up 44% and bingo halls rose nearly one-third while video lottery terminal revenue fell 0.8%.

COULD TPP SPELL DOOM FOR IP-BLOCKING PLANS?
Meanwhile, Quebec continues to forge ahead with its constitutionally sketchy plans to require internet service providers to IP-block online operators not named Espacejeux (with a possible carveout for sites linked to Montreal’s Amaya Gaming). Omnibus Bill 74, which contains the IP-blocking provision, was debated again in the provincial legislature last month and appears well on its way to becoming law.

Finance Minister Carlos Leitao has said he expects the IP-blocking will boost Espace-jeux’s annual revenue by $13.5m in its first year, rising to $27m in future years. It could also boost the provincial government’s revenue via fines issued to ISPs who defy the government’s censorship demands — $100k for initial transgressions, twice that sum for repeat offenders.

But University of Ottawa law professor and internet freedom advocate Michael Geist is warning that Canada’s involvement in the Trans Pacific Partnership (TPP) may throw a wrench into Quebec’s plans to restrict access to international gambling sites.

Several TPP signatories have specifically included gambling on the list of services that countries can shield from foreign competition (in the guise of consumer safety). But since gambling is a provincial matter in Canada, federal negotiators declined to push for this exception, opting instead to include “all existing non-conforming measures” of provinces, which doesn’t include the yet-to-be-passed Bill 74.

Regardless, Geist suggested that Quebec would have a hard time sneaking Bill 74’s gambling provisions past the TPP competition watchdogs, particularly since Leitao expressly framed the measure as a protectionist bid to boost Loto-Quebec’s revenue, until realizing that framing it as a ‘public health’ issue offered better legal cover. In the long run, the TPP could prove problematic for other provinces that attempt to restrict the rights of their residents to access gambling sites based in other TPP countries.

Amaya Gaming says it won’t offer any guidance for its 2016 earnings in light of CEO David Baazov’s bid to take the company private.

On Wednesday, the committee of independent directors appointed by the Montreal-based Amaya to consider Baazov’s $21-per-share offer released some updates on the process, including the fact that it had yet to receive a formal offer, despite Amaya’s previous claim that such an offer was expected “on or about the end of February.”

While it awaits the offer, the parent company of online gambling brands PokerStars and Full Tilt also said it had implemented some restrictions on Baazov’s management of Amaya, including how much confidential company info can be shared with the members of Baazov’s investment group.

There’s still no word on who or what comprises the group Baazov has allegedly assembled to make his alleged privatization bid. UK-listed gambling technology providers Playtech have been rumored to be sniffing around Amaya, although whether they’re aligned with Baazov or pursuing a solo bid is anyone’s guess.

Of greater interest to the wider gaming world is Amaya’s announcement that so long as Baazov continues to threaten to submit an offer, the company wouldn’t be offering any guidance on its 2016 earnings when it reports its Q4 and FY15 results on March 14.

That last decision is all the more interesting given the one-third plunge in Amaya’s share value that followed the company’s Q3 earnings report, during which it revealed it wouldn’t be hitting its 2015 earnings guidance. Amaya’s shares plunged as low at C$18.08 following Wednesday’s announcement before rallying to close down around 2% to $19.50.

On the plus side, Amaya says its Q4/FY 15 report will come out after the market closes on March 14, breaking with Amaya’s tradition of releasing such info before the market opened. Suffice it to say, many west coast analysts who resented having to rise at 4am to cover these reports are grateful.

Less than a month ago Pakistani cricket umpire Asad Rauf was handed a five-year ban by the Board of Control for Cricket in India because of his involvement in an illegal betting scandal surrounding the Indian Premier League (IPL) Twenty20 tournament. The official was found guilty of facilitating betting, disclosing inside information and receiving a gift or payment which brought the game into disrepute.

Now the sport’s global governing body, The International Cricket Council has announced that its anti-corruption unit has been able to prevent a new match-fixing plot and identify those individuals involved. "When we come by a belief that something may happen in the future, bearing in mind that we exist to prevent corruption…we decided in this particular case that we would intervene immediately.

Malta’s gaming regulator has suspended the license of online gambling operator 7epta7 Limited for as yet unspecified reasons.

On Monday, the Malta Gaming Authority (MGA) published a notice indicating that it was immediately suspending the Class 2 gaming license of the Malta-headquartered 7epta7, which does business via the 7epta7-com website.

The MGA ordered 7epta7 to indefinitely suspend all gaming operations, stop registering new players, suspend all website transactions and submit requested data to the MGA. The MGA stressed that any claims by 7epta7 sites to be operating with the approval of the MGA are henceforth bogus.

While not specifying the precise nature of what caused the suspension, the MGA’s notice invites “players who deem to have any outstanding payments due them on the mentioned license” to contact the MGA with details of the (apparently) inaccessible funds in their 7epta7 accounts.

The MGA says it won’t be releasing any further information at this stage “in order not to compromise any investigations that may need to be performed” by the MGA or any other competent authority.

The 7epta7-com site – which still currently displays the MGA logo – features messages notifying customers that they will be “Back again in less than 7 Days,” while promising that that the “Redesign of our Webportal is right in front of the Finishline… So we can re-open our Service in a few Days… Stay Tuned.” Additional notices promise “special Actions for your satisfaction” once this “great Re-Opening Party” kicks off.

Most of 7epta7’s associated social media platforms haven’t been updated in over a year. Last February, the company posted the promotional video featured below to YouTube, which could represent the final word on the company, at least until its ‘great Re-Opening Party’ gets underway.

Another step has been taken by Brazil towards launching a regulated online gambling market, after proposed comprehensive gambling legislation was amended and approved by a House of Representatives committee.

A great number of amendments proposed by senators for SB 186/2014 (pdf) were approved by the Special Committee on National Development (CEDN) on Wednesday, according to CalvinAyre.

Included in the bill’s vision for an overhaul of Brazil’s gambling market is the introduction of casinos, as well as video lottery terminals, and other options such as bingo, online sports betting, and casino products. While gambling is illegal in Brazil, a popular lottery-type drawing called “Jogo do Bicho” or “Animal Game,” is played in underground operations in 25 states, including Rio de Janeiro. The game has been outlawed by federal law since 1946, with the exception of the state of Paraiba, where it is legal and regulated.

The original version of 186/2014 had already been approved in December by CDEN. However, 16 amendments were proposed by senators. Five of them were added to the original text, including prohibiting public officials and their relatives from having any involvement in gambling business, as well as ensuring that applicants of gambling licenses are suitable.

The amended legislation now also includes defined tax rates for various gambling activities. Online gambling operators in Brazil will be made to pay twice the amount land-based operations are subject to by paying a rate of 20 percent gross revenue. The higher rate is justified by the bill by noting that much greater startup and maintenance costs are imposed by brick-and-mortar operations. That means that operators of online gambling will have a higher profit margin thus enabling the ability to pay more.

The number of online licenses Brazil intends to issue, or whether a partnering requirement between a Brazilian entity and international operators will be imposed, have yet to be determined. The bill also does not indicate the cost of a gambling license or duration. However, the bill does state that licenses issued to land-based operations will be valid for a period of 30 years. Up to 35 casinos are envisioned in the bill. Each state is allowed at least one casino, but no more than three, with companies also being limited to three apiece.

The financially struggling government estimates that once the bill is approved annual tax revenue of $4.15 billion could be earned. It is estimated by the president of the Brazilian Institute of Gaming that in order to gamble up to 200,000 Brazilians travel outside of the country each month and that Brazilian nationals comprise 70% of the gamblers in Uruguayan casinos.

New Jersey’s regulated online gambling market notched another revenue record in February, the last monthly report that won’t include contributions from PokerStars.

The New Jersey Division of Gaming Enforcement says state-licensed online gambling sites generated revenue of $14.7m in February, nearly 42% higher than the same month last year and $100k more than the sites earned in January, the previous record since the online market launched in late-2013.

As usual, the year-on-year gains were entirely driven by another stellar performance by the casino vertical, which improved 52.6% to $12.75m. In traditionally stark contrast, online poker continued its ugly stepsister role, falling 2.5% to just under $2m.

Also as usual, the Borgata/Bwin.party/Pala Interactive combo led the revenue charge with $4.24m ($3.18m from casino, $1.06m from poker). Caesars Interactive Entertainment continued its bridesmaid role with just over $3m in total revenue ($2.09m casino, $932k poker).

The Golden Nugget led the state’s three casino-only operators with $3.12m, narrowly edging out the Tropicana’s $3.05m. Resorts Digital Gaming reported $1.32m, down from January’s $1.43m, spoiling what had been an uninterrupted growth streak since the casino launched its digital offering last spring.

Resorts’ numbers will get a boost in next month’s report thanks to the launch of Amaya Gaming’s Pokerstarsnj-com site. The poker and casino site is set to soft-launch this Wednesday (16) ahead of a scheduled full launch on Monday (21).

Not to be outdone, Delaware’s three licensed online gambling sites reported February revenue of nearly $230k, just shy of the record $241k the state’s regulated market took in during April 2014. But here too, poker was in the red, falling 18% year-on-year to just over $28k. Online casino table games earned $98k (+15%) while slots and video poker brought in over $103k, more than quadrupling February 2015’s total, although this was down from the record $138k in January 2016.

According to Finder-com’s survey of 3,123 Americans, the most common drunk purchases made on St. Patrick’s Day are shoes and clothes at 7.1 percent, gambling and cigarettes tied at 6.2 percent, movies/DVDs at 4.0 percent, and technology at 3.3 percent.

The survey also revealed unplanned drunk shopping amounts to $139, but men are more likely to make more expensive drunk purchases, averaging $233 in a session, four times as much as women who spend only an average of $54 in a session.

Purchases made by drunk men and women also vary greatly, While women are more interested in shoes & clothes when they are drunk shopping, men are more interested in gambling than actually shopping online.
